NC Kazakhstan Engineering JSC (hereinafter referred to as the Company) and Oljakol LLP would like to clarify the situation regarding the payment of wages to employees at JSC Semipalatinsk Machine-Building Plant in Semey (hereinafter referred to as JSC SMZ/Plant).

Based on the results of the meeting of creditors and the agreement on reorganization in April-May of the current year, signed, among other things, by a representative of the plant’s labor collective, on June 29, 2023, by the determination of the Specialized Interdistrict Economic Court of the East Kazakhstan Region, OLJAKOL LLP (hereinafter referred to as the Sanator) was approved as a participant sanitation of SMZ JSC.

In this regard, as part of the rehabilitation procedure, in accordance with the Law of the Republic of Kazakhstan "On Rehabilitation and Bankruptcy", the Plant was transferred to the management of OLJAKOL LLP.

According to the Agreement on the rehabilitation of SMZ JSC, Oljakol LLP assumes all obligations to improve the financial and economic situation of the plant, pay off its accounts payable, as well as wages to the entire staff of the Plant.

So, in addition to the current salary, the Sanatorium from June 5 to June 8 this year. 118 employees were paid the debt for January 2023, from July 10 of this year. it is planned to pay back wage arrears for February 2023 - 116 employees. The total debt for January-February exceeds 35 million tenge.

The sanator declares that during the inventory of fixed assets and accounting of SMZ JSC, 9 employees of the Plant were identified as financially responsible persons who, despite repeated notifications, did not transfer cases according to the acceptance certificate. For this reason, wage arrears for January were not paid to these employees.

This list of employees also includes the former rehabilitation manager Allenov M.B. (from the team of the former General Director of the Plant N.S. Omarov, through whose fault, according to the general opinion, the Plant was brought to bankruptcy).

All of the above financially responsible persons have the right to receive their due wages after the transfer of cases under the acceptance certificate.

The sanatorium notes that more than half of the former employees of the Plant, from their last video message, wage arrears for January of this year. was repaid in June this year. In this regard, OLJAKOL LLP reserves the right to apply to the relevant authorities with a statement about slander and deliberate damage to business reputation.

The Company, in turn, recalls that in accordance with the decision of the Committee of Creditors of SMZ JSC dated October 26, 2022, the Company's Internal Audit Service conducted an audit, during which numerous violations were identified. The audit report was sent to the law enforcement agencies of the Abay region.

The audit report was registered by the Prosecutor's Office of the city of Semey in the book of information and transferred to the Department of Economic Investigations in the Abai region (hereinafter referred to as the Department).

The Department attached the audit report to the criminal case under Article 189, Part 4, Clause 2 of the Criminal Code of the Republic of Kazakhstan (Misappropriation or embezzlement of entrusted property of others, acts provided for in parts one, two or three of this article, if they are committed: on an especially large scale), in within the framework of which investigative actions are carried out to verify the circumstances set out in the audit report
